Virginia Suppressor Laws

Suppressors are legal in Virginia. Virginia legalizes the possession of silencers, protecting your hearing and that of those around you. Silencers and VA silencers are designated Class 3 firearms by the Bureau of Alcohol Tobacco Firearms and Explosives. These are regulated items under the National Firearms Act (NFA). Federal regulations provide for harsher penalties for criminal use. Legal oppressors are so rarely used in crime that the ATF has publicly stated that oppressors “should not be considered a threat to public safety.” If the legislature approves the prohibition of oppression in a special session next month, Virginia will join eight other states and the District of Columbia with similar laws. Silencers are regulated articles and, as such, fall under the National Firearms Act (NFA) and the Bureau of Alcohol Tobacco Firearms and Explosives. In Virginia, as in much of the country, those who can legally own firearms can also legally possess noise-canceling accessories.

Provided they comply with state gun laws and all federal regulations, mufflers can be legally owned and sold in Virginia. The legislature tried to pass a bill banning such accessories, but it failed in the Senate. While state law won`t prevent you from owning an oppressor, there are still federal laws you must obey. You need the proper federal permits to legally purchase or possess an oppressor. Those who do not follow these steps, perhaps because they buy their firearm or accessories from a friend rather than an authorized retailer, run the risk of being prosecuted. Oppressors are not a danger to society and banning them will not save lives. However, the truth about noise cancelling accessories or silencers is that they simply reduce the volume of sounds caused by the discharge of the firearm. They do not eliminate noise.
