While these guidelines use the ADA`s definition of disability, they do not address other ADA provisions that may be relevant to issues related to mask use. March 24, 2022: The U.S. Department of Education has released a letter to parents and educators regarding the new mask policy from the Centers for Disease Control and Prevention (CDC). In the letter, Secretary Miguel Cardona, Ed.D. emphasized that state and local educational agencies are bound by federal laws, including ADA Title II, Section 504 of the Rehabilitation Act of 1973 and the Education of Persons with Disabilities Act (IDEA), to ensure the inclusion of students with disabilities in the classroom. including those with post-COVID or Long COVID symptoms. The Secretary called for additional precautions to protect students, friends, neighbors or loved ones who are at increased risk of severe illness from COVID-19, including wearing well-fitting face masks and testing before gathering, regardless of the COVID-19 community level. At any level of community spread, people who are with or near people at higher risk of severe illness, people with symptoms of COVID-19, or people who are not up to date with COVID-19 vaccines, who have been in contact with someone with COVID-19, or who test positive: Take extra precautions to protect yourself and others. This includes quarantine for 5 days and properly wearing a well-fitting mask around others for 10 days. Gov. Phil Scott lifted Vermont`s mask requirement and all other COVID-19 restrictions on June 15, when the state crossed the threshold of 80% of eligible residents receiving at least one dose of the vaccine. Wearing a mask is mandatory for all people, vaccinated or not, on public transport, as well as in health and long-term care facilities. The Mississippi State Department of Health recommends face coverings in all indoor public spaces, regardless of vaccination status.
A statewide order mandating indoor mask wearing in counties with high COVID-19 cases expired in March 2021. The requirement to wear a mask in the state expired on June 2, when the Ohio Department of Health and Human Services lifted most other health orders related to the pandemic. COVID-19 safety measures remain in place in nursing homes and other residential group homes where there is an increased risk of contracting the coronavirus. In Columbus, the state`s capital and largest city, masks are mandatory in indoor public spaces, with the exception of state, federal and religious buildings. Gov. John Bel Edwards lifted the state`s blanket mask order on Oct. 27 as a delta increase in COVID-19 cases eased. The term, the second of the Louisiana pandemic, had been in effect since early August. Face coverings are still required by the state in K-12 schools (districts can opt out of the mandate if they follow CDC quarantine guidelines) and federal regulations for public transportation and health care facilities. People are encouraged to wear masks when they are within six feet of people in other households.
Employers should encourage workers to wear masks and face coverings. Governor Ralph Northam`s order to end statewide COVID-19 restrictions went into effect on May 28, two weeks after effectively lifting Virginia`s universal mask requirement to align with CDC guidelines. Employees of retail stores, restaurants, gyms and other businesses that serve customers directly must continue to wear masks. Customers are encouraged to do so. Even in schools, face coverings remain the rule. Governor Larry Hogan ended the statewide mask requirement in Maryland, along with all other COVID-19 emergency orders, on July 1. Wearing masks remains the rule in transit and transit hubs under a federal mandate. Baltimore City and the state`s five largest counties — Montgomery, Prince George`s, Baltimore, Anne Arundel and Howard — have local ordinances requiring most people, vaccinated or not, to wear face coverings in indoor public spaces.
Nevadans over the age of 9, regardless of vaccination status, must mask in indoor public places in counties that meet CDC criteria for high or significant COVID-19 transmission rates. In counties that have maintained moderate or low transmission for at least two weeks, wearing a face covering is only required for unvaccinated individuals. The stricter term covers 13 of the state`s 17 counties until at least Jan. 6, including Clark County, which includes Las Vegas, and Washoe County, where Reno is located. Gov. Greg Abbott lifted the state`s 8-month-old mask requirement on March 10. Its new policy states that Texans are “strongly encouraged” to wear masks in public, but it prevents local governments from enforcing their own face covering obligations. Anyone 5 years of age or older is strongly advised to wear a face covering indoors or in an enclosed space, except in a private apartment, and other people who are not members of the person`s household or housing unit are present in the same room or confined space. A face shield is not permitted as a substitute for a mask unless the person is performing work where wearing a face covering would pose a risk, as outlined in government safety directives, or is engaging in activities where federal or state laws or regulations prohibit the wearing of a face covering.
All people, regardless of vaccination status, are strongly advised to wear a mask when outside their home. On June 10, 2021, the CDC announced that, pending the amendment of the order dated January 29, 2021, it will exercise its enforcement discretion with respect to certain aspects of the order to avoid requiring people to wear masks outdoors on transportation or outdoors on the grounds of transportation hubs. The CDC requires federal partners and all cooperating state and local agencies to exercise similar enforcement discretion. This notice does not affect existing exceptions or exclusions to the order. Depending on how other federal partners and state and local entities define “outside,” the CDC includes “outside” for any outdoor space. According to the CDC, the factors a person should consider when deciding when to mask, the level of CDC COVID-19 community in their area, whether they are at high risk of serious illness, the risks of those around them, as well as their personal preferences and comfort level. The following masking recommendations include these CDC considerations and additional MDH considerations for individuals who are immunocompromised or at higher risk of severe disease. The current mandate was implemented in August, replacing an earlier order from the state Department of Health requiring masks to be worn indoors only for people who were not yet fully vaccinated. Employers must require (1) workers who are not fully vaccinated, (2) employees who are fully vaccinated in areas of high or high transmission in the community, and (3) otherwise vulnerable employees (due to a previous transplant or other medical condition) to wear face coverings or surgical masks indoors, unless their assignment requires a ventilator or other PPE. These employees wear a face covering or surgical mask.
