Cosmetic Packaging Requirements Canada

Canada has two official languages: English and French. Since French is mainly spoken in Quebec, this province, which is recognized as a nation within Canada, requires that cosmetic labels be provided in French and have the same effect as English (for example, the French text must appear in the same size as the English text). This is an important rule that applies to all cosmetic products sold in Quebec. Canada is a bilingual French and English country, so there are specific language requirements that reflect this. The Consumer Packaging and Labelling Act and its regulations describe the parts of the label that must be listed in english and French. These include: 19 If a cosmetic has only one label, that label must contain all the information required by these rules to appear on both the inner and outer labels. 5 Subject to section 9, no person shall import a cosmetic for sale in Canada that would be contrary to the Act or the regulations for sale in Canada. “manufacturer” means a person, partnership or association without legal capacity who sells, manufactures and sells a cosmetic product under his own name or under a trademark, design, trade name or other name or mark owned or controlled by the manufacturer; (Manufacturer) 11 If an inspector takes a sample of a cosmetic in accordance with § 23 para. 1 of the Act, the inspector informs the owner of the cosmetic product or the person from whom the sample is taken that the inspector intends to submit the sample or part of it to an analyst for analysis or examination, and (a) the cosmetic is intended for use in the eye area; Labelling requirements for cosmetic products sold in Canada are described in the following regulations: A cosmetic label must include the name and business address of the manufacturer or distributor. The name and address on the label must match the name and address submitted using the Cosmetic Registration Form (CNF). Canada`s cosmetic legislation contains regulations where certain information must appear on the label. It is therefore important to familiarize yourself with terms such as Main Display Surface (PDS), Main Display Panel (PDP), Inner Label, and Outer Label.

Other elements must be taken into account when labelling a cosmetic product: 17 No reference may be made, directly or indirectly, to the law or these regulations on the label or in the advertising of a cosmetic product, unless the reference is a specific requirement of the law or these regulations. (b) the identity of the cosmetic in relation to its common or generic name or function, unless the identity is obvious. It is mandatory to display the following details on a cosmetic label in Canada: It is currently not necessary to indicate an expiry date on a Canadian cosmetic product. To ensure that their cosmetic product is used safely, many brands choose to provide an expiration date. Decorative container: a container which, except on the floor, does not contain any advertising or advertising material other than a trademark or common name and which appears as a decorative ornament by reason of a design on its surface or because of its shape or texture and which is further sold as a container of a cosmetic as a decorative ornament; (decorative container) Compliance with the Consumer Packaging and Labelling Act means that you must ensure that the requirements listed above are met. Therefore, the label must contain all mandatory information (including the name or characteristic of the product, the net quantity, and the name and address of the retailer). In addition, the law expressly prohibits the display of false or misleading information on the label. This includes written descriptions as well as illustrations or symbols. 20 Subject to those provisions, the internal label of a cosmetic device 21(1) No manufacturer may indicate any of the following on a label or in an advertisement for a cosmetic product, unless the manufacturer has evidence confirming the claim: (c) anything which he considers, for good reason, to be or may be used for manufacture; the preparation, preservation, packaging or storage of cosmetic products; and 18 The particulars required by this Regulation on the label of a cosmetic (3) In the case of perfumes and flavours, the words `perfume` or `flavour` may be inserted at the end of the list of ingredients to indicate that those ingredients have been added to the cosmetic in order to produce or mask a particular odour or taste.
